Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek regular bail in connection with Udwant Nagar P.S. Case No. 124 of 2022 lodged under Sections 147, 148, 149, 337, 338, 323, 307, 302, 504, 109,506 of the I.P.C.
As per the F.I.R., it is stated by the informant that 12 named accused persons armed and in the stage of intoxication started abusing. The allegation against petitioner no. 1 was that he is member of mob and was threatening that "kill them and
Patna High Court CR. MISC. No.34466 of 2022(3) dt.19-09-2022 2/3 don't leave" whereas allegation against the second petitioner is that he was member of mob and abusing in the stage of intoxication. It has also stated by the informant that the cause of event is land dispute.
Learned counsel for the petitioners submit that there is no specific allegation against the petitioners. All the allegations are general and omnibus in nature. The cause of the dispute is old land for which there is already pending disputes between the parties. Learned counsel further submits that the petitioners are in custody since 28.03.2022 having clean antecedent, charge sheet has already been filed in this case. Learned counsel further submits that the co-accused Ranjan Singh and Kiran Devi has been granted bail by the Co-ordinate Bench of this Court vide order dated 14.09.2022 and 25.08.2022 passed in Cr. Misc. No. 33984 of 2022 and Cr. Misc. No. 30580 of 2022 respectively. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Bhojpur
Patna High Court CR. MISC. No.34466 of 2022(3) dt.19-09-2022 3/3 at Ara in connection with Udwant Nagar P.S. Case No. 124 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
