JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gaunaha P.S. Case No. 79 of 2014 registered under section 366-A, 370-A, 372 and 373 IPC, sections 7,11 of POSCO Act and section 5 of the Prevention of Immoral Traffic Act.
According to the informant, his minor daughter was taken by the mother of the co-accused Sk Lal Babu five years ago. The girl was subsequently sold to some other accused persons. The accused persons started utilizing the services of the petitioner in orchestra party.
The contention of the petitioner is that he is neither named in the FIR nor any statement of the girl was made under section 164 Cr. P.C. At a subsequent stage of investigation it has

It is also stated that the two co accuseds namely Bhukhal Ram and Sk. Lal Babu have since been released on bail vide order dated 28.04.2015 passed in Cr. Misc. Nos. 5714 of 2015 and 51529 of 2014 respectively. The petitioner is in custody since 15.12.2014.
Considering the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction 1st Addl. District and Sessions Judge-Cum-Special Judge, West Champaran at Bettiah in Gaunaha P.S. Case No. 79 of 2014 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge he shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, his bail bonds shall be cancelled.
