Learned counsel for the applicant/appellant, under instruction, submits that the applicant has challenged the interim order passed by the Collector, Aurangabad before the learned Single Judge, however, the petition filed by the applicant/appellant was not entertained by the learned Single Judge. In the meantime, against the order passed by the learned Single Judge, the present appeal has been filed. It is also pointed out from the record that there is a delay of 33 days caused in preferring the present appeal for condonation of which the appellant has filed I.A. No. 01/2023.

3. At this stage, learned counsel submits that during the pendency of the present proceedings, the concerned authority has passed the final order and, therefore, the applicant has filed a fresh writ petition before the learned Single Judge. Learned counsel, therefore, submits that, in view of the development which has taken place after the filing of the present appeal, this appeal has become infructuous. Therefore, he seeks permission to withdraw this appeal.

4. Permission, as prayed for, is granted.

5. Appeal stands disposed of as withdrawn.

6. Accordingly, I.A. No. 01/2023 also stands disposed of.

7. It is clarified that we have not examined the merits of the case of the appellant.
