The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, while the informant was conducting a raid with respect to seizure of illicit liquor it is stated that the accused persons including the petitioner herein started to protest and the petitioner assaulted the informant with a lathi causing injury on his hand.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to oblique reasons. The alleged injuries are simple in nature which

Patna High Court CR. MISC. No.44257 of 2021(2) dt.24-01-2022 2/2 would be evident from the injury report brought on record in this petition. The petitioner is in custody since 27.1.2021 and charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation, the injury report of the informant together with the petitioner having remained in custody for about 1 year, the Court directs the petitioner to be enlarged on bail in connection with Madhwarpur P.S. Case no. 11 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st, Benipatti, Madhubani.
