JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-05-2015 The petitioner seeks bail in connection with Sahebganj P.S. Case No.66 of 2013 registered for the offences punishable under sections 435 and 387 read with 34 of the Indian Penal Code. The prayer for bail of the petitioner along with other two coaccused was earlier rejected by this Court vide order dated 11.9.2014 passed in Cr. Misc. No.35056 of 2014 with following observations:- "The learned S.D.J.M., (West) Muzaffarpur is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within seven months from the date of receipt/production of a copy of this order failing which the petitioners would be entitled to renew
Patna High Court Cr.Misc. No.18352 of 2015 (2) dt.20-05-2015 2/2 their prayer for bail."
It has been contended that though the petitioner is in custody since 14.2.2014 but till date only seven out of 11 witnesses have been examined during trial. The witnesses who have deposed in court have not supported the case of the prosecution and have been declared hostile.
Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur in connection with Sahebganj P.S. Case No.66 of 2013.
