The petitioner seeks regular bail in connection with Warisnagar P.S. Case No.146 of 2023 registered for the offence under sections 363 and 366-A of the Indian Penal Code and under section 8 and 17 of the POCSO Act. 3.

The petitioner is said to have kidnapped the daughter of the informant. He is in custody since 21.12.2024. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner and the victim were in relationship.

Learned counsel for the informant has vehemently opposed the prayer of the bail for grant of bail. 6.

From the statement of the victim girl, it appears that she has got married to the petitioner and is staying with the family members of the petitioner.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge, VIcum- Special Court (POCSO), Samastipur / concerned Court below, in connection with Warisnagar P.S.
