2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code and section 12 of the POCSO Act.

3. Allegation against the petitioner and other coaccused person is of kidnapping the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. The statement of victim girl recorded under section 164 of the CR.P.C has been reproduced in para-31

No.34055 of 2025(4) dt.15-09-2025 2/2 of the case diary in which, she has stated that on 10.04.2024, she left her house with Shivam Kumar and his cousin brother Chandan Kumar and she solemnized marriage with Shivam Kumar. Except this there is nothing against the petitioner. The petitioner is in custody since 31.01.2025 having clean antecedent.

5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail, in connection with Dumra P.S. Case No. 167 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI, cum Special Judge, Sitamarhi.
