The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 379/34 of the Indian Penal Code and Sections 17, 18 of the Protection of Children From Sexual Offences Act. Prosecution case in nutshell is that while the daughter of the informant was alone at her home, coaccused Akhlesh Kumar, on the instance of the petitioners enticed away the minor daughter of the informant. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have

Patna High Court CR. MISC. No.34879 of 2022(2) dt.28-11-2022 2/2 falsely been implicated in the present case. It is further stated that daughter of the informant has left her house with her own will. It is also submitted that after completing investigation, the petitioners were not sent up for trial but differing with the final form, cognizance has been taken. A statement has been made in para 3 of the petition that petitioners have clean antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII-cum-Special Judge, POCSO, Bettiah, West Champaran in connection with Manpur P.S.
