The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner is not named in the FIR nor was present at the time of recovery of foreign liquor from a pick-up van. Name of the petitioner surfaced during investigation. Petitioner has got no criminal antecedent.

Considering the fact aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below

Patna High Court CR. MISC. No.31632 of 2019(2) dt.14-05-2019 2/2 where the case is pending in connection with Special Case No. 2500 of 2019 arising out of Mokama P.S. Case No. 44 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property.
