The petitioner seeks bail in connection with Khanpur P.S. Case No. 162 of 2018 registered for the offence punishable under Section 376 of the Indian Penal Code and Sections 4 and 8 of the Protection of Children from Sexula Offence Act, 2012. The prosecution cse is that on 31.10.2018 at about 8.00 P.M., informant's sister has gone to purification in mustered field her aged about 15 years. In the meantime, the petitioner has come in mustered field and rape his sister, she is speechless, thereafter, she has speechless sound, then some persons having going to purification in the field and seen the petitioner has raped the victim girl, thereafter some persons
Patna High Court CR. MISC. No.31907 of 2019(3) dt.28-08-2019 2/2 have apprehended the petitioner but the petitioner has flee away. Thereafter, the informant and help of the other persons have reached at P.H.C. after treatment the doctor has referred Sadar Hospital, Samastipur.
Learned counsel for the petitioner submits that the charge is framed by the court below.
In the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected. However, the trial court is directed to concluded the trial within one year. (Anjani Kumar Sharan, J) Nasimul/- U T
