2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) (d) of the Bihar Prohibition and Excise Act-2018.

3. It is alleged that 180.00 liter Banti Babli country made wine Masala was recovered from four gunny bags.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

5. However, learned counsel for the State opposed the bail petition and submits that petitioner has got two criminal antecedent of similar nature.

6. Considering the facts of the case as also the fact that petitioner has got criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
