2. The petitioner seeks bail in connection with Daraunda P.S. Case No.19 of 2024, dated 03-02-2024, registered for offences punishable under Sections 302,363,366,376, 341 and 323 of the Indian Penal Code.
3. The prosecution case, in short, is that the informant, Neetu Devi, alleges that her neighbor, Golu Kumar (petitioner), who has a criminal background, started teasing and harassing her daughter. When the informant's son, namely Roshan, objected to such misbehavior, the petitioner pretended to be friendly and deceived Roshan into accompanying him. On 28.12.2021, the petitioner, along with his family, allegedly gave Roshan a cold drink mixed with poison. Thereafter, the petitioner informed the informant that Roshan was feeling

However, Roshan told his mother (the informant) that the petitioner had given him something suspicious, and soon after, he became very sick. Despite receiving medical treatment, Roshan died due to poisoning. When the informant informed the villagers about the incident, the petitioner and others threatened her to prevent her from taking legal action. It is further alleged that the police took no action despite several complaints, thereby encouraging their criminal activities. On 20.06.2023, the petitioner's father allegedly instructed the abduction of the informant's daughter, namely Khushi Kumari, who was forcibly taken at gunpoint. The informant has a strong apprehension that the petitioner may murder her abducted daughter at any moment, and accordingly, the First Information Report (FIR) was registered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is submitted that the petitioner is the husband of the victim, Khushi Kumari, who is the daughter of Subh Narayan Singh. As per the FIR, the alleged occurrence took place on 28.12.2021, whereas the FIR was lodged only on 03.02.2024 after a delay of about two years and one month. It is further submitted that the allegation against the petitioner is
Patna High Court CR. MISC. No.33526 of 2025(3) dt.06-08-2025 3/3 false and concocted. There is no iota of evidence to suggest the petitioner's involvement in the alleged occurrence. The case appears to have been instituted merely on account of the petitioner's marriage with the informant's daughter, which the informant opposed. Lastly, it is submitted that the petitioner has been in custody since 02.03.2025 and has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Siwan, in connection with Daraunda P.S. Case No. 19 of 2024.
7. The application stands allowed.
