During the pendency of this application, the police appear to have submitted a final report under Section 173 of the Code of Criminal Procedure and the petitioner has not been sent up for trial.

It cannot be said, therefore, that the petitioner has any apprehension of arrest in course of investigation as of date. This application for anticipatory bail cannot be entertained. Learned counsel for the petitioner has submitted that notice has been sent to the informant by the Court below, on the said final report submitted by the Police.

It goes without saying that the petitioner may take recourse to legal remedy as may be available to him, should there

be any apprehension of his arrest in future, in connection with Jehanabad (Mahila) P.S. Case No. 57 of 2015, pending in the Court of learned Incharge Chief Judicial Magistrate, Jehanabad. Considering the above, this application stands disposed of accordingly, with the observations as above.
