ANJANA MISHRA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Giriyak P.S. Case No.124 of 2019 for allegedly having committed the offence under Sections 147, 148, 149, 379, 341, 323, 307, 353, 279, 504 and 506 of the Indian Penal Code and Section 4/40 of the B.M.M.C.Act, 1972 and Sections 3/4/6 of the Bihar Mineral Prevention of Illegal Mining Transportation and Storage Act, 2003. Learned counsel for the petitioners submits that neither the tractor belonged to the petitioners nor were they involved in the illegal trade of sand. It is further

Considering the fact that there is no specific allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge, Biharsharif, in connection with Giriyak P.S. Case No.124 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
