Petitioner seeks bail in a case registered under sections 399, 402 of the Indian Penal Code as well as sections 25 (I-b)a, 26, 35 of the Arms Act.

One country made loaded pistol and two live cartridges are said to have been recovered from conscious possession of the petitioner when petitioner and others assembled to make preparation for committing dacoity.

Petitioner is in jail custody since 6.12.2015 and according to the prosecution case itself, petitioner and his associates were arrested from a hotel while they were taking meal.

Moreover, petitioner does not have any criminal antecedent. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
