The petitioner apprehends his arrest in connection with Barun P.S. Case no. 87 of 2019, registered under Section 379, 420 and 411/34 of the Indian Penal Code, Section 4/40of BMMCR Act and Section 5 of the Environment Protection Act. Two illegal sand laden tractors were apprehended by the informant. Petitioner happens to be owner of the one of the tractors.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has been falsely implicated in this case. Petitioner happens to be owner cum driver of the tractor bearing registration no.BR 26 GA 4314 and
Patna High Court CR. MISC. No.33593 of 2019(3) dt.07-08-2019 2/2 he was transporting the soil from the Sone canal for the purpose of filling the house and on the way his tractor was seized by the informant as the petitioner refused to cough up the demand of graft made by the informant.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 87 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
