JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. At paragraph-24 of the case diary, the victim has specifically, stated about the story of rape and witnesses stated that the petitioner had made extra-judicial confession before them. Therefore, considering the facts and circumstances of the case as well as submissions of the parties, I am not inclined to extend the privilege of bail to the petitioner and, accordingly, his prayer for bail in connection with Kadwa (Balia Belon) P.S. Case No. 164 of 2014 stands rejected.
