JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 At the outset, counsel for petitioner seeks permission to withdraw the anticipatory bail application of Lakha Yadav @ Naulakh Yadav petitioner no. 1, as during pendency of this case he has been arrested.

Permission is granted. The anticipatory bail application is dismissed as withdrawn having become infructuous.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

It is submitted that there is no specific accusation of assault against this petitioner rather allegation is general and omnibus. Petitioner is a lady and claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth, Bhojpur at Ara in connection with Bihiya P.S. Case No. 462 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
