JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 21.11.2014 in connection Naubatpur P.S. Case No. 314/2014 registered under section 302 IPC and section 27 of the Arms Act lodged by the brother of the deceased alleging that he was informed by the villagers that his brother was indiscriminately assaulted by 11 accused persons named in the FIR.

The contention of the petitioner is that the informant is not the eye witnesses to the occurrence. The allegation is general and omnibus. In course of investigation no one has named the petitioner about specific allegation of assault on a particular point of body of the deceased. The post mortem report suggests two fire arms injuries sustained by the deceased. The petitioner has no

Patna High Court Cr.Misc. No.18992 of 2015 (2) dt.09-07-2015 2/2 criminal antecedent. Several co accuseds of this case have since been released on bail. Learned counsel has referred in this regard to the order dated 23.03.2015 (Annexure-2).

Considering the aforesaid facts, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class Sri Kumar Madhevendra, Danapur, Patna in Naubatpur P.S. Case No. 314 of 2014 on condition that one of the bailors shall be own/close family member of the petitioner. As soon as the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds.
