JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case has been registered under section 25(1-b)a, 26 and 35 of the Arms Act and according to the prosecution case itself, illegal firearms were recovered from possession of co-accused whereas nothing was recovered from possession of the petitioner.
No doubt, petitioner does have some criminal antecedent but considering the facts of the present case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S.Case No. 174 of 2015.
