JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned counsel for the opposite party No. 2.

The petitioner apprehends his arrest in connection with Complaint Case No. 01 (C) of 2021, registered for the offences punishable under Sections 498 (A) of the Indian Penal Code. There was allegation against the petitioner that he inflicted cruelty to the complainant for non-fulfillment of dowry demand. For exploring the possibility of amicable settlement of the dispute the matter was referred to Patna High Court Mediation and

Patna High Court CR. MISC. No.45201 of 2021(3) dt.12-07-2022 2/2 Conciliation Centre.

As submitted, the mediation process became successful. The couple is residing together. Though, the learned counsel for the complainant has submitted that the complainant still apprehends maltreated by the hands of the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Hilsa, Nalanda in connection with Complaint Case No. 01 (C) of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. with the further condition that the petitioner at the time of his surrender shall sworn an affidavit that in further he shall not inflict atrocities upon the complainant. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
