The petitioner seeks bail in a case under section 302, 201/34 of the Indian Penal Code.

Petitioner is the husband of the deceased. Father of the deceased alleged that his daughter was married with the petitioner about 12 years ago but he came to know that his daughter died. On enquiry his grand son disclosed that his daughter was killed and cremated.

It appears that the I.O. did not take the statement of the grand son of the informant and took the statement of other witnesses who disclosed that the deceased fell ill and during the course of treatment she died. The informant also in his further statement disclosed the same facts that his daughter died during

Patna High Court Cr.Misc. No.18454 of 2015 (3) dt.02-07-2015 the course of treatment.

Considering the facts and circumstances aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Mallehpur P.S. Case No. 31 of 2014.
