JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 328 of the Indian Penal Code.

Petitioner is not named in the first information report but submission on behalf of the petitioner is that petitioner and some others were arrested in Dhangai P.S. Case No. 21 of 2015 and after that petitioner as well as other accused were remanded in the present case without any material and except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody since 04.09.2015. It is further submitted that moreover, several co-accused have already been granted privilege

Patna High Court Cr.Misc. No.11601 of 2016 (2) dt.15-03-2016 2/2 of bail by different Benches of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Dinkar Kumar, Judicial Magistrate 1st Class, Bhojpur at Ara in connection with Dhangai P.S.
