JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Rail Patna Junction P.S. Case No. 366 of 2015, registered under Section 379 and 411 of the Indian Penal Code. The accusation is that while the informant was present at the Karbigahia booking counter at that time one person took the mobile from his pocket and gave the same to his associate, when informant made hulla, both the persons started to flee away. Later on, petitioner and one Kamal Nut were apprehended.

Learned counsel for the petitioner submits that it would appear from the seizure list that the alleged mobile of the informant has been recovered from the possession of co-accused

Patna High Court Cr.Misc. No.13784 of 2016 (2) dt.25-04-2016 2/2 Kamal Nut and petitioner has no concerned with the said mobile. Further submission is that, in fact, in course of purchasing the ticket at booking counter hot talk were exchanged between the petitioner and informant and due to that reason petitioner and other has falsely been implicated in this case. Further submission is that petitioner having no criminal antecedent is in custody since 05.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Patna in connection with Rail Patna Junction P.S.
