JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 If the petitioners are aggrieved by the implementation of the direction of this Court, liberty shall be available to the petitioners to challenge the decision before the appropriate forum, as the scope of contempt jurisdiction is not available to scrutinize the merit of the merit list.
Accordingly, this application stands disposed of. So far as I. A. No. 1 of 2019 for exemption of cost is concerned, the Court in the facts and circumstances of the case is not inclined to accept the contention of the opposite parties, as the State is represented by the counsel and as such there is presumption that State was aware of the order passed by the Court.
In view of the above, I.A. No. 1 of 2019 is rejected. The opposite parties have to deposit the cost in terms of the order within a period of one month from today. (Anil Kumar Upadhyay, J) uday/- U
