JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 325, 427 & other minor sections of the Indian Penal Code and u/S 27 of the Arms Act.

Petitioner is not named and submission on behalf of petitioner is that name of the petitioner came in confessional statement of co-accused, Ashok Tanti and except the aforesaid material as well as some criminal antecedent of the petitioner; there is nothing against the petitioner who is languishing in jail custody since 23-09-2015.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.11558 of 2016 (2) dt.15-03-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Banka P.S. Case No. 459 of 2015 corresponding to Sessions Trial No. 354 of 2015, Tr. No. 384 of 2016 to the satisfaction of Sri S.P. Singh, learned Additional District & Sessions Judge-IV, Banka.
