JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.07.2014 in a case registered for the offences punishable under section 328, 302, 34 of the Indian Penal Code. The prosecution case is of killing the sister of the informant after ten years of marriage when the petitioner, being husband of the victim, was caught while taking the victim on a cot.

It is submitted by learned counsel for the petitioner that admittedly the marriage was performed 10 years prior to the occurrence and the victim was being taken for medical assistance which shows the bonafide of the petitioner while co-accused Dasrath Manjhi has been granted bail by this court in Cr. Misc.

Patna High Court Cr.Misc. No.18511 of 2015 (2) dt.22-06-2015 2/2 No. 2556 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.
