The petitioner seeks bail in connection with Sessions Trial No.01 of 2014, arising out of Kadam Kuan P.S. Case No.207 of 2013 registered under Sections 399, 402, 414 and 401 of the Indian Penal Code besides Sections 25(1-B)A, 26 and 35 of the Arms Act.

The allegation is that the police apprehended five persons in suspicious condition, who disclosed about committing the theft of bicycles and also disclosed about keeping the bicycles at the house of the petitioner and one Md. Babloo alias Habib. Thereafter, police recovered five stolen bicycles from the house of

Learned counsel appearing on behalf of the petitioner submits that while the prayer of the petitioner for bail was rejected thrice but the petitioner having no criminal antecedent is in custody since 13.06.2013. It is also submitted that having similar allegation co-accused, Md. Babloo alias Habib, has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 03.10.2013 passed in Criminal Misc. No.41313 of 2013.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Patna, in connection with Sessions Trial No.01 of 2014, arising out of Kadam Kuan P.S. Case No.207 of 2013.
