Petitioners apprehend their arrest in connection with Pachrukhi P.S. Case No. 48 of 2019 registered for the offence punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Minor daughter of the informant is said to have been kidnapped by one Manu Kumar and petitioners have facilitated in her kidnapping by the said accused. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in this case merely because they happens to be parents, brother and

Patna High Court CR. MISC. No.31744 of 2019(2) dt.13-05-2019 2/2 uncle, respectively, of Manu Kumar. Petitioners have no concern with the aforesaid occurrence. They have not facilitated the kidnapping of the victim by Manu Kumar. Victim in her statement recorded under Section 164 Cr.P.C. has frankly stated that she was in love with Manu Kumar and she had suo motu left for Manu Kumar at Gorakhpur and performed marriage with him. She has not named the petitioners in the occurrence. Petitioners have no criminal antecedent.

On the other hand, learned APP opposed the bail prayer of the petitioners.

In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Siwan, in connection with Pachrukhi P.S. Case No. 48 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
