JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-07-2024 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of appropriate writ, especially in nature of Mandamus, directing the respondents to allot one of the vacant plots, preferably Plot No.- 8M/94, situated at Bahadurpur within the town and district-Patna in place of plot no.- 4M/142 in the same locality. Patna High Court CWJC No.8504 of 2024(2) dt.22-07-2024 2/3 No.- 4M/142 has earlier been allotted in the name of petitioner's mother, namely, Sipty Baskey (now deceased) vide letter No.- 1691/AA dated 27/07/1991 issued under the signature of respondent no.- 5 and in pursuance of said allotment petitioner's mother had already submitted necessary requisites along with duly signed agreement and premium amount of Rs. 16,071/- but till date possession has not been given on one pretext or other and the plot 4M/142 got merged in a park in subsequent Map of the Housing Board.

Further prayer for the issuance of appropriate writ, especially in the nature of Mandamus, directing the respondents to complete the required paperwork in favour of the petitioner relating to the settlement of the vacant Plot No.- 8M/94/ in place of earlier allotted plot No.- 4M/142."

At the outset, the learned counsel for the petitioner seeks a direction upon the Managing Director, Bihar State Housing Board, Patna to dispose off the pending application filed by the petitioner on 19.12.2022.

Per contra, the learned counsel for the respondent-State submits that in case the aforesaid application filed by the petitioner is still pending, the same would definitely be disposed off.

Having regard to the prayer made by the petitioner in the present writ petition, I deem it fit and proper to direct the Managing Director, Bihar State Housing Board, Patna to dispose off the aforesaid application, in case the same is still pending consideration, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
