2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148, 323, 324, 307, 353, 332 and 504 of the Indian Penal Code.

3. It is alleged that all the F.I.R named accused persons including these petitioners brutally assaulted the chowkidar with lathi, danda in which he sustained injury.

4. It is submitted that allegation of assault is general and omnibus against this petitioner. There is no injury report on the record. Petitioners have not caused any hindrance in

Patna High Court CR. MISC. No.34874 of 2023(2) dt.27-07-2023 2/2 discharge of official duty of the police personnel. Petitioners claim clean antecedent.

5. Learned counsel for the petitioners oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM Raxaul at Motihari in connection with Palanwa PS Case No. 14 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
