Petitioner is in custody in Economic Offence P.S. Bihar Patna Case No.13 of 2012 instituted under Section(s) 20(b) (ii)(c), 21, 23 and 29 of the NDPS Act pending before the Additional Sessions Judge VII-cum-Special Judge, NDPS Act, Patna.
Prayer of the Petitioner for bail was rejected twice by this Court.
This application has been filed for grant of provisional bail to the Petitioner for attending the marriage ceremony of his sister.
In the nature of allegation, I am not inclined to take
Patna High Court Cr.Misc. No.18851 of 2015 (2) dt.22-04-2015 2/2 risk of releasing the Petitioner on provisional bail. Hence, prayer of the Petitioner for provisional bail is rejected.
The Trial Court is directed to expedite the trial without granting unnecessary adjournment to any party for which reason the Trial Court shall send a list of the witnesses fixing specific dates for their examination along with a copy of this order to the concerned Superintendent of Police, who is directed to take active steps for ensuring the attendance of the witnesses on the date(s) fixed since the offence is very serious.
