The petitioner is languishing in custody since 20.09.2014 for the offences instituted under Sections 121A/120B of the Indian Penal Code, 25(1-B)/35 of the Arms Act, 3⁄4 of the Explosive Substance Act and Sections 17/18/19/21/22 of the Unlawful Activities (Prevention ) Act.

It has been submitted on behalf of the petitioner that the petitioner has been falsely been implicated in the present case and due to mistake of fact they have been made accused in this case. There is no specific allegation against this petitioner. On behalf of the State it has been submitted that the petitioner is Naxal and has criminal antecedent also.

Patna High Court Cr.Misc. No.19156 of 2015 (4) dt.02-09-2015 P2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to this petitioner. The same is rejected. Anyhow, the trial court shall take all necessary steps to conclude the trial of the case preferably within a period of six months.
