JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are languishing in jail custody since 0410-2014 in a case registered under Section-379 of the Indian Penal Code on the ground that in course of investigation, they were caught with stolen Bolero.

Paragraph-3 of the petition reveals that petitioners do not have any criminal antecedent and it is stand of the petitioners that on the alleged date of recovery, the father of petitioner No. 2 was seriously ill and they have requested one, Prem Pandit to provide vehicle to them and thereafter, the said Prem Pandit gave vehicle to them for carrying the father of the

Patna High Court Cr.Misc. No.3441 of 2015 (3) dt.20-04-2015 2/2 petitioner No. 2 to the clinic of one Dr. Dubey. Further stand of petitioners is that they brought the father of the petitioner No. 2 by the aforesaid vehicle but unfortunately, they were caught by the police.

Considering the aforesaid facts and circumstances as well as submission of the parties, as also keeping in mind that petitioners do not have any criminal antecedent and investigation against them has already been completed, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Phulwaria P.S. Case No. 121 of 2014 to the satisfaction of Sri A. Kunal, learned Judicial Magistrate-Ist Class, Gopalganj.
