JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-09-2019 The learned counsel for the petitioners has limited the prayer made in the present writ petition to the effect that since the records of Execution Case No. 1 of 1985 are not available with the learned Civil Court, Patna, the same be directed to be reconstructed.
Since this Court is not in seisin of First Appeal No. 585 of 1994, pending before this Court and other records, it would not be proper to express any opinion, however, in the interest of justice, the petitioner is granted liberty to file a proper application before the learned District Judge, Patna who would enqure into the matter regarding the records of
Patna High Court CWJC No.10723 of 2018(3) dt.03-09-2019 3/3 Execution Case No. 1 of 1985 and do needful in that regard, in accordance with law.
The writ petition stands disposed off on the aforesaid terms.
