JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dariyapur P.S. Case No. 127 of 2021 registered under Sections 30 (a)/30(b)/33 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 30.05.2021, and is a person of clean antecedent and charge-sheet has been submitted. Learned counsel submits that from perusal of the allegation as alleged in the F.I.R. it was manifest that allegation is of recovery of 802

Patna High Court CR. MISC. No.45363 of 2021(2) dt.10-12-2021 2/2 litres of liquor from the house of Anil Kumar Rai alongwith 1200 empty bottles. It is alleged that Anil Kumar Rai disclosed that it was this petitioner who had supplied the aforesaid liquor. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case based on the confessional statement of Anil Kumar Rai when he has no concern with the said liquor.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 30.05.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Iind Additional Sessions Judge- cum- Special Judge, Excise, Saran at Chapra in connection with Dariyapur P.S. Case No. 127 of 2021.
