In course of investigation, it came to light that looted mobile was being used inserting new sim and thereafter, police detected that the concerned sim had been issued in the name of one Gita Devi. Husband of the aforesaid Gita Devi was interrogated and his statement was recorded in para 102 of the case diary in which husband of Gita Devi stated that the petitioner had sold the aforesaid mobile to him and later on, he had returned said mobile to the petitioner. It appears from perusal of the aforesaid materials that except the above stated statement as well as some call details coupled with confessional statement of the petitioner, there appears to be nothing against the petitioner.

No doubt, petitioner carries criminal antecedent but taking note of materials available against him in the present case as well as

No.3545 of 2015 (4) dt.20-04-2015 his period of detention in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Jhanjharpur, Madhubani in Bhairavsthan P.S. Case no. 26/2014.
