15-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Phulwarisharif (Janipur) P.S. Case No. 54 of 2021, registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., four named accused alongwith some other persons have fired upon the husband of the informant, as a result of which, he sustained two gun-shot injuries and while being taken to the hospital, he was declared dead by the doctor. Petitioner is not named in the F.I.R. Name of the petitioner has come merely on suspicion and on the basis of confessional statement of other co-accused persons. Save & except confessional statement, there is no other material against this petitioner to show his complicity in the aforesaid crime.

Patna High Court CR. MISC. No.45239 of 2021(2) dt.15-11-2021 2/2 Petitioner has got clean antecedent and he is in custody since 24.01.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 54 of 2021.
