JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-03-2022 After some arguments, the learned counsel for the petitioner seeks to withdraw the present petition, however, submits that the trial court be directed to expedite the trial.
At this juncture, it is submitted that all the witnesses, except the Doctor and the Investigating Officer, have been examined.
Having regard to the submissions made by the learned counsel for the petitioner, in presence of the learned counsel for the State, Sri Bal Mukund Prasad Sinha, this Court deems it fit and proper to direct the learned court of Additional District and Session Judge-VII, Samastipur in
Patna High Court CR. MISC. No.43426 of 2021(3) dt.03-03-2022 2/2 connection with Session Trial No. 77/2021 arising out of Kalyanpur P.S. Case No. 129/18, G.R. No. 1965/18 to conclude the trial preferably within a period of six months from today.
It is further directed that the Superintendent of Police, Samastipur shall ensure that the official witnesses i.e. the Doctor and the Investigating Officer are produced before the learned trial court forthwith and in case of any delay, this Court shall be constrained to take appropriate action against the Superintendent of Police, Samastipur.
Accordingly, the present petition stands disposed of as not pressed, however, with the aforesaid directions.
Let a copy of this order be transmitted immediately to the learned court below as also to the Superintendent of Police, Samastipur.
