JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2016 Heard learned counsels for the petitioner and the State. The petitioner has renewed his prayer for bail as he is languishing in custody since 10.01.2011 in a case registered for the offences punishable under sections 21 and 22 of the N.D.P.S. Act.

For recovery of 170 Kg. of Ganja the case was registered.

Considering the recovery, twice the prayer for bail of the petitioner was rejected vide order passed in Cr. Misc. Nos. 39218 of 2011 and 44950 of 2012.

A report was called for from learned Additional Sessions Judge-I, Lakhisarai about the stage of trial and expected period in which the trial was likely to be concluded. The report of

Patna High Court Cr.Misc. No.11697 of 2016 (3) dt.06-04-2016 2/2 learned lower court reflects that out of eight charge sheet witnesses three have been examined and for the rest non bailable warrant of arrest has been issued. The trial is likely to be concluded within six months.

Considering the stage of trial, this court is not inclined to enlarge the petitioner on bail. The prayer for bail is rejected. The Superintendent of Police, Lakhisarai is directed to get the witnesses produced in connection with Barahiya P. S. case No. 02 of 2011.
