The petitioner is apprehending his arrest in connection with Simri P.S.Case No.10 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018..

Allegation against the petitioner is about recovery of huge quantity of liquor from the Bolero and the other accused persons were arrested.

Submission of the learned counsel for the petitioner is that he was not present at the spot rather he has a Navy personnel and he was on duty at Kochchi at that time and he has been falsely implicated in this case. He has no knowledge about carrying of the liquor by his vehicle.

No.32994 of 2019(4) dt.05-09-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to produce any certificate before the learned Special Judge that he was present at Kochchi at that time and the learned Special Judge, if satisfied with the same, shall release the petitioner on bail to his own satisfaction however, if the petitioner fails to produce the certificate or the Special Judge is not satisfied with the authenticity of the certificate, he has to surrender and pray for regular bail. With the aforesaid direction, this application is disposed of.
