The petitioner seeks bail in a case registered under Sections 457/379 of the Indian Penal Code.
The prosecution case in brief is that six deities including the deity of Radha Krishna of the temple were found missing. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-01-2019. Charge sheet has already been submitted. The petitioner is not named in the FIR. His name transpired in this case on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from possession of the petitioner. An idol is said to have been recovered from possession of the
Patna High Court CR. MISC. No.32671 of 2019(2) dt.17-05-2019 2/2 co-accused Prince Kumar. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 28-02-2019 passed in Cr. Misc. No. 11026 of 2019.
On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Gopalganj in connection with Phulwariya P.S.
