====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-02-2022 Heard the parties through virtual court proceedings. Petitioner seeks regular bail in connection with Kanhauli P.S. Case No. 66 of 2021 registered for the offence under Sections 392 of the I.P.C.

As per the prosecution story, while the informant was returning back to his village on his Scorpio, his car was over taken by two motorcycle borne miscreants, who snatched the Scorpio vehicle of the informant and after some time informant got an information that one Scorpio vehicle was stuck in mud near Mudhadih Kumdi and on that information he proceeded towards the aforesaid place and recovered his Scorpio vehicle and also apprehended one biker Tara Singh @ Kunal Singh (i.e.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village rivalry and he has not committed any offence in the manner alleged. He further submits that petitioner has got no criminal antecedent and from perusal of the First Information Report it would appear that petitioner was not arrested by the Police but it was the informant who handed over the petitioner before the Police. He further submits that the fact of the matter is that a minor accident had taken place between the Scorpio vehicle and the petitioner's bike and scuffle had taken place due to which the petitioner has been implicated in this false case. Petitioner is in custody since 13 - 5 - 2021 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 13 / 5 / 2021 , charge sheet has already been submitted and trial is not likely to be concluded in near future due to Covid 19 pandemic, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be

Patna High Court CR. MISC. No.43861 of 2021(2) dt.04-02-2022 3/3 released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Kanhauli P.S. Case No. 66 of 2021.
