2. The petitioners seek bail in Excise (Patna) P.S. Case No. 2211 of 2026 registered under section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 300 litres of illicit country made liquor from the old and damaged house.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely being implicated in the present case. Petitioners have no concern with the seized article.

Patna High Court CR. MISC. No.34039 of 2026(2) dt.19-05-2026 2/2 Petitioners are not the owner of the concerned house. Petitioners have clean antecedent and they are in custody since 07.04.2026.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioners.

6. Considering the facts and circumstances of the case and the clean antecedent of the petitioners, this Court is inclined to grant bail to the petitioners.

7. Accordingly, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise III, Patna /concerned court below in connection with Excise (Patna) P.S. Case No. 2211 of 2026.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
