JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Srikrishna Puri P.S. Case No. 267 of 2015, registered under Sections 356 and 379 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner is not named in the F.I.R as on the basis of the written report of the informant Shiv Kumar Guddu F.I.R. was lodged against person having Mobile No. 7033350597. In course in investigation, the photograph of the petitioner was shown to informant who identified him as snatcher of his laptop, but it would appear from the F.I.R. itself that informant has not claimed to identify the culprit on seeing them again.

No.13769 of 2016 (2) dt.25-04-2016 2/2 Further submission is that while the petitioner has been made accused as detailed in paragraph 3 of the petition, but the petitioner is on bail in all the said cases except Gandi Maidan P.S. Case No. 350 of 2015. The petitioner is in custody since 24.09.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Khusboo Srivastava, Judicial Magistrate, 1st Class, Patna in connection with S.K.Puri P.S. Case No. 267 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
