The petitioner seeks bail in connection with Complaint Case No.232 of 2020, registered for offence punishable under Section 498(A) of the Indian Penal Code.

On 10.03.2022 both the parties had appeared physically. Thereafter on 31.03.2022, the following order was passed: "Heard the parties.

Learned counsel for the petitioner, during the course of argument on instruction, has submitted that he is ready to return two kathas of land which was transferred by the girl family in the name of the petitioner before marriage.

This will be done within a period of 15 days from today. Put up this case after four weeks for further hearing. Till the next date of hearing, the interim order dated 03.03.2022 shall continue."

The learned lawyer for the petitioner has now changed and

Patna High Court CR. MISC. No.43799 of 2021(7) dt.05-05-2022 2/2 new arguments are being advance on behalf of the petitioner. The petitioner has not yet acted as per this undertaking before this court made on 31.03.2022. The interim order dated 03.03.2022 is vacated.

This order be communicated to the Magistrate concerned dealing with Madhepura Complaint Case No.. The court below shall take all the steps against the petitioner and proceed in the matter. The allegation against the petitioner is of demand of dowry and torture in a marriage, which was solemnized on 17.06.2019 and the complaint was filed on 12.08.2020 i.e. less than an year of the marriage. This kind of the behaviour of the petitioner and the allegations against the petitioner is serious in nature. The petitioner has also violated the undertaking given before this Court. Considering the facts and circumstances of the case and the petitioner has also violated the undertaking given before this Court, the application for anticipatory bail is dismissed.
