JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 376 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case this petitioner is alleged to have sexually abused the victim on the promise of marriage. It is also alleged that he demanded dowry.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that victim in her statement u/s 164 of the Cr. P. C denied the allegation of sexual assault. She stated that she solemnized marriage with petitioner on 10.03.2021 but

Patna High Court CR. MISC. No.35671 of 2022(3) dt.06-12-2022 2/2 later on he snatched Rs. 5,17,000/- and dropped her at Phulparas and fled away. The police after investigation submitted charge sheet u/s 498A, 420, 504/34 of the IPC. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani in connection with Phulparas PS case No. 172/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
