JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-04-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner Munna Singh @ Munna Kumar wants to renew his prayer for bail which has already been rejected by order dated 11.07.2014 passed in Cr. Misc. No. 16683 of 2014 on the ground that only charges have been framed and there is no likelihood of early conclusion of trial. Co-accused Sarvesh Kumar @ Sarvesh Kumar Singh and Tunni Singh @ Ratnesh Singh have been allowed bail vide Cr. Misc. Nos. 11649 of 2015 and 16417 of 2015, to which the learned A.P.P. is not in a position to distinguish the case of the petitioner.

Considering that up till now only charges have been framed and the allegation attributed against the petitioner is not

No.20364 of 2015 (2) dt.29-04-2015 2/2 specific and as two co-accused have been allowed bail and as such the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Vaishali at Hajipur in Vaishali P.S. Case No. 288 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
