Earlier the bail application of the petitioner was rejected vide order dated 02.09.2015 with a direction to the learned Trial Court to expedite the trial of the petitioner and conclude the same preferably within a period of one year. From perusal of the Letter No. 10796/2015 submitted by learned Sessions Judge, Vaishali at Hajipur, it has been pointed out that on 02.09.2015 the case of the petitioner was not committed to the Court of Sessions. It is further pointed out that now the case has been committed to the Court of Sessions on 20.11.2015 and the case was fixed for framing of charge on 07.12.2015. In the meantime, an application for discharge has
Patna High Court Cr.Misc. No.19201 of 2015 (4) dt.13-01-2016 2/2 been filed on behalf of the petitioner and the date fixed for hearing on the point of discharge was 22.12.2015. Hence, in the said circumstances, it has been prayed on behalf of the learned Trial Court that one year time may be granted from the date of framing of charge for concluding the trial.
Considering the prayer made on behalf of the learned Trial Court, the learned Trial Court is directed to conclude the trial of the petitioner preferably within a period of 10(Ten) months from the date of framing of charge.
The order dated 02.09.2015 stands modified to the extent as indicated above.
