1. Heard learned Counsel for the parties concerned.

2. The petitioner has filed the present writ application being aggrieved by the order, dated 09.02.2016, passed by the Sub Divisional Officer, Sherghati, Gaya, whereby the P.D.S. license of the petitioner's shop has been cancelled. Further, the appeal, bearing Supply Appeal No. 12 of 2016, preferred by the petitioner has been dismissed by the District Magistrate, Gaya and cancellation of the PDS license of the petitioner's shop has been affirmed.

3. Learned Counsel for the State, referring to Rule 32 (vi) of the Bihar Targeted Public Distribution System (Control)

Patna High Court CWJC No.8529 of 2020(4) dt.13-02-2024 2/2 Order, 2016, submits that there is provision of statutory revision before the Divisional Commissioner and the petitioner, without availing the statutory remedy, has approached this Court.

4. In view of the fact that there is provision for statutory revision, this writ application is disposed with liberty to the petitioner to file revision before the Divisional Commissioner within a period of four weeks from today and if such a revision is filed by the petitioner, the Divisional Commissioner shall be obliged to consider and dispose the same in accordance with law within a period of two months from the date of filing of the revision.
